Special Ops Paintball Limited
PLEASE READ BEFORE SIGNING RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OR RISK, AND INDEMNITY AGREEMENT
THIS IS A HIGH-RISK ACTIVITY
YOU ARE PLAYING ENTIRELY AT YOUR OWN RISK
This waiver applies to all activities at Special Ops Paintball Limited, including but not limited to Airsoft. These are active, physical sporting outdoor activities, often involving the elimination of opponents via the firing of BBs from airsoft guns.
I Understand That:
1. I am participating in an active physical outdoor sporting activity and confirm I am in good health to participate. If I am unwell, I will notify a member of staff immediately.
2. There are hazards on site, including but not limited to man-made structures, fallen trees, dead branches, sharp objects, uneven ground, and holes. I will take due care at all times.
3. I must participate in accordance with the stated rules and safety briefing, which I will listen to carefully and ask questions if I do not understand.
4. This activity may involve risks of serious bodily injury, including bruising and broken skin from paintball or BB impacts, if I do not participate according to the rules of the venue.
5. Removing my mask in the game area could result in serious eye and/or facial damage.
6. I WILL NOT REMOVE MY MASK FOR ANY REASON OUTSIDE THE BASE CAMP. DOING SO WILL RESULT IN MY IMMEDIATE EXPULSION FROM THE PREMISES WITHOUT REFUND.
I Confirm and Agree That:
1. I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation, save where caused by the negligence of Special Ops Paintball Limited, its servants, or agents.
2. If I have any injuries, illnesses, disability (whether physical or otherwise), requests, requirements, or any other special circumstances which may impact, impair, or in any way affect my ability to fully participate or which may endanger the safety of myself or others, I will advise Special Ops Paintball Limited of the full nature and extent of same prior to registration.
3. Special Ops Paintball Limited will endeavour where possible to facilitate such requests where same are considered to be safe, appropriate, and reasonably practicable. I understand that Special Ops Paintball Limited reserves the right to refuse admission and/or the right to play at any time.
4. I will wear the provided full face protection (eye and mouth) and will not remove it while in the game area.
5. I will wear suitable clothing and footwear at all times, including clothing that covers the entirety of my arms and legs.
6. I will obey all marshal safety rules and instructions as presented in the safety briefing and throughout the sessions.
Photography and Video
I am aware that I may be in photos or videos taken by Special Ops Paintball Limited or other players, and I consent to those images and content being used for promotional or marketing activities. If I do not wish to be included in such images or videos, I will make this known in writing to Special Ops management before the commencement of play. I understand I may withdraw this consent at any time by contacting Special Ops Paintball Limited in writing.
CCTV and Security
CCTV and other security systems are operational across various areas of the premises, including but not limited to the car park, base camp, and game zone locations. These systems are implemented for the purpose of ensuring the safety and security of all patrons and staff. Any intentional interference with or damage to these systems will incur liability for the costs of repair or replacement. Pursuant to the General Data Protection Regulation (GDPR), all personal data captured by CCTV is processed in accordance with applicable data protection laws of the Republic of Ireland.
Release and Waiver of Liability
I hereby release, discharge, and covenant not to claim against Special Ops Paintball Limited, its servants and agents, or any other individual acting on behalf and with the lawful authority of Special Ops Paintball Limited, other participants, and if applicable, owners/lessors of the premises on which the activity takes place (hereinafter called "Releasees") from all liability, claims, demands, losses, or damages on my account, save where caused by the negligence of Special Ops Paintball Limited, its servants, or agents, and in respect of any damage to property or goods save where caused by such negligence.
Nothing in this agreement shall exclude or limit liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, or any other liability which cannot be excluded or limited by law.
Indemnity
Subject to the limitations above, I further agree that if, despite this release, waiver of liability, and assumption of risk, I or anyone on my behalf makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any loss, liability, damage, or cost which any may incur as the result of such claim, except to the extent that such claim arises from the negligence of the Releasees.
Declaration
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT AND FULLY UNDERSTAND ITS TERMS. I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
